Commercial Banking & Financial Institutions Law

Pahl & McCay brings recognized expertise to the representation of banks, commercial finance, leasing companies and other financial institutions, providing assistance in negotiating, documenting, restructuring and, when necessary, litigating financial transactions, including all aspects of the Uniform Commercial Code. In addition to representing financial institutions, we also represent our clients as borrowers in negotiating and structuring financial facilities, as well as obtaining real estate construction and permanent lending.

We advise our clients on preventative steps in connection with commercial, credit and real estate transactions, potential lender liability exposure and the purchase and sale of assets of companies in foreclosure, default or bankruptcy, in addition to advising and negotiating on behalf of non-debtors in problem loans or other troubled financial situations to achieve an advantageous resolution.

Our attorneys assist banks, commercial finance companies and other commercial creditors in maximizing the recovery of their claims through workouts, collection, judicial and non-judicial foreclosure, receivership, pre-judgment remedies (including ex parte writs of attachment and possession), and all aspects of Creditors' Rights in Bankruptcy (including non-dischargeability actions, relief from stays and post-petition financing arrangements).
